Business Law ASIC v Healey & Ors 2011 FCA 717 †Free Samples

Question: Examine about the ASIC v Healey Ors [2011] FCA 717 (Centro Case). Answer: Presentation The Australian Securities and Investment Commission (ASIC) started legitimate procedures against six non-official chiefs and two administrators of the Centro substances. The six non-official directors were previous non-official administrator and the two administrators were previous CEO. The ASIC started the legitimate procedures on the ground that all the respondents had contradicted their lawful obligation of care and determination towards the Centro substances, by endorsing the united money related records for the Centro elements for the monetary year that finished on 30 June 2007 (Stuart 2015). The solidified budget summaries wrongly ordered $1.5 billion paying off debtors as non-current liabilities where truth be told, they were current liabilities. They further neglected to uncover US$1.75 billion in ensures which was later seen as a fundamental occasion that had been gone into post the equalization date. The inability to unveil such noteworthy and significant issues and the misclassification of the momentary obligation trouble as a progression of non-current liabilities erroneously introduced the transient obligation weight of the organization. The executives were seen as blameworthy in negating the directorial obligations specified under the Corporations Act 2001 (Cth) (the Act) regarding the consideration and perseverance that they are committed to show in the situation of Directors in this manner, disregarding segment 180(1), 601FD(1) and 344(1) of the Corporations Act 2001 (Cth) (the Act). This case didn't held that the chiefs were unscrupulous yet that they neglected to make sensible strides that that law commits the executives to take while they act in the situation of the chiefs of the organization. Obligations penetrated by the Directors The executives have been held at risk for negating area 344(1), 180(1) and segment 601FD (1), segment 296, 297, 298 of the Corporations Act 2001 (Cth) that necessary them to release their directorial obligations with due consideration and steadiness. As indicated by segment 180 (1) of the Act, a chief or some other official of a partnership are committed to practice their forces and release their obligations with due consideration and watchfulness that would be practiced by some other sensible individual if such individual was in the situation of the Directors of the organization. The sensible individual will have indistinguishable obligations from that of the chiefs (Banerjee and Humphery-Jenner 2016). The Directors have been discovered subject for repudiating their directorial obligations specified under area 180(1) of the Act on the accompanying grounds: The executives neglected to give legitimate consideration while perusing and understanding the substance of the CPL reports as for the arranging of liabilities as current or non-current; the disclosure of the important assurances; The chiefs neglected to appropriately evaluate the substance of the CPL reports with respect to the order of liabilities and exposure of important assurances; The chief neglected to make adequate enquiry with the administration, the Board Audit and Risk Management Committee and other Board individuals in regards to the disappointment of the CPL Financial reports to sort the liabilities; exposure of the CPL reports. They neglected to give sufficient consideration to the administration portrayal letter gave to the chiefs; inability to meet the necessities indicated under segment 295A of the Act. The chiefs were not furnished with a presentation as for segment 295A of the Act. The ASIC has additionally asserted that the main litigant, Brian Healey, has disregarded area 601FD (1) and (3) of the Act. As indicated by segment 601FD (1), the principal respondent has neglected to practice due consideration and steadiness that would be practiced by any sensible individual if such individual was in the situation of the chiefs (Keay 2014). An executive is required to represent the government assistance of the individuals from the organization and in the event that there emerges irreconcilable circumstance between the substance and the individuals; the chiefs must give greater need to the enthusiasm of the individuals. According to area 601FD (3) of the Act, any individual who negates subsection 1 of the Act will be said to have repudiated this subsection also and a chief must not deliberately disregard subsection 1 of the Act. The principal litigant negated the referenced segment regarding the Centro Property Trust by his lead on 6 September 2007. Being an official of the CPT Manager Limited, he casted a ballot for the goals that affirmed the yearly money related report or the CPT Financial Report and yearly executives report (CPT Directors report) for the year that finished on 30 June 2007. The reports were affirmed in any event, when CPT money related report was not in consistence with the guidelines of bookkeeping specified under segment 296 of the Act. Further, the fiscal summaries and the notes in the CPT Financial Report contradicted segment 297 of the Act as the budgetary report gave a bogus and unreasonable examination of the monetary situation of the element as there was misclassification of the liabilities and non-exposure of the momentary obligation weight of the organization (Velasco 2014). The executives were additionally asserted to have repudiated segment 298 of the Act as the CPT Directors Report didn't give any subtleties of the Relevant Guarantees that was legitimately required to be given under area 299 (1) (d) and 299A of the Act. According to segment 344 of the Corporations Act 2001 (Cth), a chief of an organization will be dependent upon common punishment in the event that he neglects to find a way to act as per the directorial obligations that would have been practiced by any sensible individual in the situation of the executive and under similar conditions. Basic examination of the choice of the Australian Federal Court The Federal court opined that the chiefs of the organization are honest, experienced and savvy individuals and there is nothing to recommend that the executive didn't release their directorial obligations genuinely and steadily (Strine 2014). Be that as it may, under certain particular conditions, it very well may be seen that the chiefs have neglected to make sensible strides that they were lawfully committed to take and have likewise neglected to play out their obligations practicing the degree of care and perseverance that was expected of them by law. Concerning the significance of the issues that they knew about, the executives ought not have confirmed reality of the budget summaries and distributed the yearly reports when there was no revelation of the noteworthy issues (Laing, Douglas and Watt 2015). The court additionally expressed that had the chiefs applied their psyche as for the fiscal summaries and distinguished the centrality of the undertaking, every executive would have enquired about the issues that were not uncovered to them. It was basic for the chiefs to audit the fiscal summaries and made appropriate enquiry about the issues unveiled by those budget reports. The issue encompassing the lawful continuing has been whether the executives of the freely recorded elements were required to apply their insight and brains while surveying the proposed report of the chiefs so as to discover that the substance of the report is reliable with the information controlled by the executive as for the undertakings of the organization. The chiefs ought to have guaranteed that the substance doesn't forget about material issues that was known to the executives. The court expressed that a chief is vital to the administration and course of the any association and the pretended by the executive may have a profound effect on the investors, banks, workers yet additionally on the network. The chiefs are generally responsible for guaranteeing that reports are appropriately evaluated, embraced, and endorsed after adequately scrutinizing the archives. The executives must survey the substance of the reports with the information that they have by ideals of the position that the chiefs hold (ODonnell et al. 2015). The conflict that viable examination of each record before their endorsement overburdens the executives will not be thought about as the chiefs get great compensation and gold an esteemed position which requires to them to release their directorial obligations and show due consideration, constancy and knowledge while releasing their duties. While clarifying the noteworthiness of the position held by the executives, the court expressed that the law gives upon the chiefs a final and an imperative duty to be engaged with the administration of the organization and find a way to act to the greatest advantage of the association and its individuals. The law additionally commits the chiefs to painstakingly examine and see each report before affirming or embracing it and must guarantee the precision and reasonableness of the substance of the record preceding the arrangement of any feeling that is communicated in the assertion under segment 295(4) of the Corporation Act 2001 (Cth). For this reason, the chiefs must guarantee that the fiscal summaries are reliable with the information controlled by the Directors. A chief must focus more on the issues of the organization that expect him to act industriously and apply his knowledge while releasing the directorial obligations. The situation being what it is of this case, the chiefs neglected to practice their obligation to scrutinize and fathom the archives and make important enquiries identifying with the decency of the budget summaries. Since the chiefs are not required to take an interest in the everyday exercises of the organization nor are they required to have vast information or capacity, it is relied upon from them to release their essential obligations practicing due consideration and perseverance. The executives guaranteed help from obligation on the ground that they depended on the board and the examiners; consequently they are not subject for contradicting

Jack Kevorkian

I feel that probably the greatest unnatural birth cycle of Justice that I saw in the course of my life was that of Dr. Jack Kevorkian getting a 10 to multi year sentence for needing to help end the enduring of a powerless individual. Named â€Å"Dr. Death† by the media free for all that followed the activities of the disputable doctor, he got this sentence for assisting with closure the life of multi year old Thomas Youk. who was taking on a sad conflict with Lou Gehrig's illness. Dr.Kevorkian set up his â€Å"suicide machine† In request for the individual to knowllngly and deliberately scatter the compound creation that would end the enduring of the casualty his family. In spite of the fact that Dr. Kevorkian aided the passing of 35 individuals, It was the Thomas Youk case that brought national consideration and in this way the fierceness of the criminal Justice arrangement of the territory of Michigan. Like phsyclan-sulclde Is the Issue of both intentional and Involun tary dynamic willful extermination. Both of these Involve doing the demise of another individual, who either intentionally or unknowllngly makes that decision. What puts forth the defense of Dr. Kevorkian diverse is that he met with the entirety of his patients and recorded the way that they were intelligent and ready to settle on their own choice about the taking their life. I am speculating that when the Thomas Youk story broadcast on an hour in 1 998, it brought national scutiny and a joke of the laws according to the Michigan criminal equity framework. I needed to more readily comprehend this idea the points of interest about this case and what the mind-boggling popular sentiment on the theme was broadly and inside the territory of Michigan.Thomas Young had been languishing over years with Lou Gehrig's diesease, a moderate killing sickness that in the end removes al pride from the person. As of late he had been losing significant pieces of his lung capacities and been stifling al l alone salive. This man, all together, settled on a cognizant choice to end the enduring that accompanied this horrendous sickness. Numerous individuals from his family talked on the side of Dr. Kevorkian at the preliminary and during the condemning producure. Youk's sibling Terry said † Kevorkian was the main individual with the â€Å"courage and backbone to challenge those indequate and uncalled for laws. As per the article almost 2 to 1 Michigan occupants bolstered the law prohibiting this kind of activity by a physican a this Is entirely near the national level with respect to this subject. As per our content â€Å"A study of 988 in critical condition patients found that 60. % said they bolstered euthanasian or doctor helped self destruction all in all, however just 10. 6% revealed truly considering it for themselves† (Rathus, p. 397) I think this demonstrates regardless of the way that numerous individuals bolster It, they are hesitant to seek after It for some s orts of reasons.I Imagine that one of the most famous reasons Is connected to relglous confidence and how that would be seen according to God. I surmise everybody has their sincere belief on the issue and Ilkewlse ought to have their own decision on the most proficient method to pass on with pride without putting a further enthusiastic and money related weight upon their family. I never comprehended that as a general public we can be viewed as altruistic by killing a creature in the event that it is managing a fatal sickness, yet when this equivalent sort of thought comes to individuals, the mentality radically changes.Dr. Kevorkian carried out 8 years of this punishment for what I see as a complete foul play Schiavo case, where she was left in a coma for a long time, causing a fight in court between her family and her significant other have brought numerous â€Å"end of life† issue to the front line. I am a pushed for individual decision on numerous issues and I unquestionab ly would need to concur with Dr. Kevorkian, Thomas Youk, and the numerous others he elped to bite the dust with poise. I imagine that the significant error that Dr.Kevorkain made was his eagerness to carry this point to national media. In spite of the fact that this pointed out the current subject, it additionally exasperated the specialists of the state where her played out the doctor helped self destruction. Another part of the Youk case that makes it exceptional is that Dr. Kevorkain really began the â€Å"suicide machine† on the grounds that Youk couldn't genuinely do it due to his ailment. This minor detail put forth the defense progressively Justifiable in a lawful way since he really started the synthetic substances to stream in to Youk's body. Jack Kevorkian Jack Sovereign helped patients with self destruction utilizing a willful extermination gadget he imagined named the â€Å"Damnation†, named after the word â€Å"Atonally' which means â€Å"The investigation of death†. Another gadget DRP. Sovereign utilized was the â€Å"Immersion† (leniency machine), concocted by Thomas Yuk, a patient of DRP. Asseveration's.The way the Damnation machine works is three canisters are mounted to the gadget in which one is loaded with a saline arrangement, another is brimming with a barbiturate called sodium formative, and the last canister is loaded with a blend of potassium chloride, which stops the earth and anarchy bromide, a muscle loosened up that forestalls fits during the withering procedure. An associate will start the saline arrangement stream, and afterward the patient will convey the barbiturates by method of a switch, catch, or pulling a string. And last, a trigger or clock will convey the deadly portion of the last cani ster. Passing is easy and happens inside 2 minutes. The Immersion is an essential gadget containing a canister of carbon monoxide connected also face veil with a cylinder. A valve or an extemporized handle, contingent upon the patient's handicap, is discharged or gone to low the progression of the gas. This technique took around 10 minutes and patients were urged to take narcotics previously, to quiet and unwind them.Jack Sovereign had no second thoughts about helping his patients; he Just wished he would have done It before In his life so he wouldn't have spent the most recent couple of long stretches of his life in jail. DRP. Sovereign had no goals of consistently helping patients again with self destruction however in light of the fact that in his words, It wasn't worth â€Å"suffering† In jail. He felt It was a misuse of his time on the grounds that no different specialists were sufficiently daring to remain with him In his convictions.

The Appropriate Words for a Given Audience To be compelling, an essayist must pick words dependent on various elements that relate legitimately to the crowd for whom a bit of work is proposed. For instance, the language picked for an exposition on cutting edge polynomial math would not just contain language explicit to that field of study; the essayist would likewise have the desire that the proposed peruser had a propelled degree of comprehension in the given topic that at any rate approached, or conceivably outpaced their own. Then again, a writer composing a childrens book would pick age-proper words that children could comprehend and identify with. In like manner, while a contemporary dramatist is probably going to utilize slang and saying to associate with the crowd, a craftsmanship history specialist would almost certainly utilize increasingly formal language to portray a bit of work about which the person is composing, particularly if the target group is a companion or scholastic gathering. Word Choice for Literature Apparently, picking viable words when composing writing is more entangled than picking words for creation composing. Initial, an author must consider the imperatives for the picked discipline wherein they are composing. Since abstract interests as, for example, verse and fiction can be separated into a practically interminable assortment of specialties, kinds, and subgenres, this by itself can be overwhelming. Furthermore, essayists should likewise have the option to separate themselves from different journalists by choosing a jargon that makes and supports a style that is valid to their own voice. When composing for a scholarly crowd, singular taste is one more immense deciding variable concerning which essayist a peruser considers a decent and who they may discover unbearable. That is on the grounds that great is emotional. For instance, William Faulker and Ernest Hemmingway were both viewed as monsters of twentieth century American writing, but then their styles of composing couldn't be progressively extraordinary. Lay vs Lie Verbal Basics

‘Lay’ and ‘Lie’ are two words which often confuse English speakers. The confusion stems from the fact that both the words have a close meaning to put something down. However, there is a distinct difference between the two words. And no we are not lying about it 🙂 When you use the word lay, it refers to some object which is being laid down. You can lay a cup on the table or lay a box in the car. When you say, â€Å"I lay a cup on the table†, you is the subject whereas the cup is the object. You certainly never lie a cup on a table or lie a box in the car. Lie, in this case, means to stay at rest in a horizontal position. So, you ‘lie’ down to take rest. In this scenario, the subject i.e you is taking the action of taking rest. The present participle of lie is lying whereas for lay is laying. While it may seem a little confusing, doing a lot of reading and writing practice will make you familiar with its usage. The most important thing to remember is that ‘lay’ has an object while ‘lie’ does not have an object. This rule will help you sail through this question, should it present itself during the exam. Let’s lay this topic to rest now! Attempt a few practice questions to test your understanding. Img credit: ragan.com

Analysis Of The Movie The Night - 996 Words

Brianna flinches slightly as Josh stands up, the empty spot on the hospital bed slightly discomforting to her. She nearly reaches out to grab his hand, afraid that she would never see him again once he leaves the room. Brianna s mother silently examines the pair; the way Brianna s eyes turn sad as Josh stood, and the way Josh s eyes softened, reassuring her that he would be back. As they leave the room, Josh finds it unusual that Brianna s mother did not argue to stay in the room. She was family, he is sure that they would have made an exception. Yet, here they stood, together in the dimly lit hallways, coughs echoing across the bare walls every now and then. He watches as the doctors scramble to keep the girl breathing. Josh notices the pronounced stab wound on the woman s chest. He wonders what possibly would have happened to the woman, what vicious man would do such a thing. The sight of the woman is enough to remind Josh of Brianna s state only a few hours prior. Effects Of Outdoor Air Pollution And Its Effects On Human...

The research presented in this paper will discuss poor air quality due to outdoor air pollution and its’ effects on human health. I have examined numerous documents, learning about the anthropogenic causes of the air pollution in addition to studying the hazards the contaminated air presents to the public, particularly in urban areas. I have created a policy that I believe directly addresses the current needs of the atmosphere in order to continue to reduce the amount of pollution in the air we breathe, in turn improving our overall health. This is emitted into the air every time an automobile is driven and is extremely dangerous to breathe in. (About Air Toxics) Not only is benzene emitted when automobiles are driven, but it is also used in factories that produce plastic, nylon and numerous other chemicals. This puts those working in industrial areas at an even higher risk due to their increased exposure. Benzene is so hazardous to the body because it alters the way cells function and can often impair the immune system. After only a few hours of minor exposure, this pollutant can cause numerous symptoms, including drowsiness, dizziness, irregular heartbeat and headaches. As exposure increases the body can experience more

a. Why did you choose this book? -The title of the book, â€Å"Cicada Summer†, captivates my eyes, I thought that this book would be about a vacation and I like that kind of novels. Then, when I read what this book is all about, it captures me, because I really like novels about mysteries and solving puzzles and problems. And that’s why I chose this book. ? b. What was the book about? -The book was about twelve-year-old narrator Lily, a motherless child, who has exiled herself to a self-imposed silence and isolation after a hinted-at tragedy that involved her older brother Pete.Interwoven with the story of a mysterious girl, named Tinny, who suddenly moves into their town. Lily and Tinny faced trials and problems which involves their family and love ones. c. How did you rate this book? oExciting oInteresting oDull oOkay A Book Review I’m pretending to be Lily Mathis, as the girl who loves to read Nancy Drew books, who’s good in spying and keeping secrets. Furthermore, technology was witnessed to prevail at the end of the story, as a source of progress in Animal Farm such as installing a telephone and subscribing to magazines. Animal farm also portrayed a comparison between the leadership approaches of human with that of the pigs that controlled the farm. In Animal Farm, old Major the boar on the Manor Farm, called the animals for a meeting and made a speech, Major explained to the animals that they are enslaved and exploited, and that man is to blame. Old Major was a visionary leader, he communicated his vision and mission clearly to the animals and stated that ‘Whatever goes on two legs is an enemy’. Old Major instructed the animals ‘that in fighting against man we must not come to resemble him’, ‘Even when you have conquered him, do not adopt his vices’. Major also outlined the seven commandments that the animals followed which stated that, no animal must ever live in a house, sleep in bed, wear clothes, drink alcohol, smoke tobacco, touch money and engage in trade. Major also professed that all the habits of man are evil, no animal must ever kill another animal and that all animals are equal. Soon after old Major died, two pigs named Napoleon and Snowball assumed command and commenced planning the attack on Mr. Jones the owner of the farm who treated them with cruelty, seldom fed them, stole the products of their own labor and whipped and slaughter them at his discretion. Napoleon and Snowball conducted meetings with the animals and motivated them which were revolutionary as they revolted and drove Mr. Jones away from the farm. However, the animals’ victory and new found freedom would not last long, as the greed and power of Napoleon and the other pigs took dictatorship over all the other animals on the farm and completely reversed all Major’s commandments and did the exact opposite of what Major told them to do. The modification of the seven commandments caused the animals to follow rules that went against the original laws which had dictated the entire purpose of the animals’ revolution against man. Napoleon essentially resembles the human, as he now portrays the human behavior and the animals are not able to distinguish the difference between the humans and the pigs. Therefore, the other animals on the farm are now faced with the harsh cruelty that even after the revolution they were still exploited and enslaved by the pigs. The Parallels which exist with Business Communication Communication is the process of transferring information and meaning between senders and receivers, using one or more written, oral, visual, or electronic channels. The essence of communication is sharing, providing data, information and insights in an exchange that benefits both you and the people with whom you are communicating. In Animal Farm the animals communicated with each other by conducting group meetings, engaging in debates, forming committees, written communication by the use of seven commandments which acted as their policy and law to follow. The ways in which the animals operated bear a close resemblance to that of the operations and structure of an organization. The animals communicated both externally and internally. Communication channels such as word of mouth was utilized to transfer information and messages, for example Mr. Whymper acts as an intermediary between Animal Farm and the outside world, he receives and pass on communication from Napoleon to the other humans and spread rumors about the activities on the farm, as well as collect and sell eggs. Also, the pigeons were used as messengers to spread news about the rebellion to the other animals on farms across England, which caused animals on the other farms to lash out and rebel against their human masters. Napoleon and Snowball conducted meetings every Sunday with all the animals where the work for the upcoming week was planned out and resolutions were put forward and debated by the pigs, and everyone voted for the resolution symbolizing equality among the animals, an adherence to one of the commandments that all animals are equal. Business communication involves a constant flow of information, it is goal oriented. The rules, regulations and policies of a company have to be communicated to people within and outside the organization. Business communication is regulated by certain norms and rules. Rules are often thought of as ways to maintain generally accepted notions of orders. The commandments and traditions set up by the pigs immediately after the rebellion are meant to unite, motivate and energize the animals. The flow of communication subsequently changed after the rebellion. Firstly, the flow of communication between the animals was horizontal, such that communication took place between animals of equal status in the farm. Secondly, downward vertical communication had occurred where decisions was made by Napoleon and the other pigs, and had to be communicated to and explained to the other animals of their duties and responsibilities. Finally, the structure of the farm became centralized where all decision making was being undertaken by Napoleon and the other pigs. In order to for an organization to survive and be effective, they must have a plan and implement strategies. In Animal Farm, Napoleon and Snowball constructed plans and strategies for the animals to follow, also strategic plans that included tactic to prevent humans from trying to recapture the farm, Mr. Jones and Mr. Frederick both attacked the farm, however failed. Business plans are very vital in the survival of an organization, the plan to resist and eventually conquer Mr. Jones was a product of scanning, understanding their threats, strengths, weakness and opportunities. Snowball embarked on various campaigns for social and economic improvement, by making plans to construct a windmill that would produce electricity. Napoleon also used negotiation as a strategy to sell animal farm timber to Frederick and Pilkington. Snowball also formed committees between the animals and trained them to read and write. Throughout Animal Farm, it was evident that technology was a source of progress at the farm. However, technology was useless unless in the hands of human, for example when the windmill was finished it was used to for milling corn instead of its original purpose of supplying the animals with electricity in their stalls. Despite their lack of knowledge on technology they installed telephones and subscribed to magazines, made plans to build a school, proving that with the ever prevailing technology the animals would have improved their intelligence and become advanced Power, Leadership and Corruption The basic task of a leader is to influence or motivate group members to commit themselves to the goals and work to achieve them. After the rebellion against Mr. Jones, the pigs were the ones that took on the task and leadership roles of organizing and mobilizing the other animals because they were generally recognized as being the cleverest of the animals, thus they took power and the hierarchy of intelligence in the animals of the farm ultimately became the hierarchy of power. The pigs were reliant on the ignorance and lack of education of the other animals, and their inability to see the corruption of the pigs. To the extent that the animals did not question the pigs, they became complicit in the corruption of their ideals. Deception and punishment was used to gain power, they quell the animal’s questions and protested by threatening Mr. Jones return and Napoleon used dogs to run Snowball out of the farm and he killed any animal that disobeyed him. At first the pigs were loyal to their fellow animals and the revolutionary cause, however it was soon realized that Napoleon had a hidden agenda and the leadership diverted from a democratic or participative leadership style to an autocratic approach. Napoleon adopted an autocratic leadership approach, such that he took control over all the animals, he never consulted anyone before making decisions and the animals didn’t question them because they respected and feared him. For example, Boxer was the most dedicated and respected animal on the farm, he believed whatever was said by Napoleon was right and in the end he was betrayed and exploited by Napoleon. Napoleon also delegated tasks to Squealer who persuaded and convinced the workers that everything that Napoleon did was for the benefit of all the animals on the farm. Also, Squealer frequently made amendments to the commandments anytime Napoleon and the other pigs were in breach of the commandments. For example when the pigs started sleeping in the beds the commandment was changed from no animals shall sleep in a bed to no animals shall sleep in a bed with sheet, all the seven commandments was eventually replaced to ‘All animals are equal, but some animals are more equal than other’. Napoleon also used violence and fear to frighten the animals into submission. Conclusion George Orwell goal in writing Animal Farm was to speak out against the Russian Communism and to show that the rulers were ruling cruelly. In society where people have no choice, the ruling body with privileges such as special education, luxury and titles, has an absolute power, this will lead to corruption and disintegration of values.

Integration Of Project Management And Organizational †Free Samples

Question: Discuss about the Integration Of Project Management And Organizational. Answer: Introduction According to Heraclitus nothing is permanent except change especially in business where change is a constant procedure and needed to remain viable. Change can massively impact schedules, budgets, technologies and deliverables. Only certain types of change can be controlled but through the ability of respond, adapt and anticipate we can deal with changes which cannot be controlled. The report discusses the impact of change management in time, cost and quality of a project along with the associated risk. Impacts of the Change in the project In the inception phase the objectives was changed due to urgent demand of completing the whole tower and to ensure the publicity concern. In developing phase the work development start after two year of initial tower project due to budget issues. For budget issue project managers are change the tower design which started affect relationship with the original architect and may have helped create a chain reaction of subsequent problems (Suma Lakshmi, 201). In implementing phase the heavy elevator impact the project including delays of project opening, security and scope change. Due to the heavy wind 6 days per week, budget overrun of 12 $ million to 15 $ million the opening of the tower to the public delayed and after 100 days it shut down for an extend amount of time to repair the broken bearing at the base of the tower. Change Discussion Impact on project Techniques to Solve BUDGET The initial budget US 12$ million exceeds to 15$ million The schedule appeared to have been very loose Management of change within the project is a complex task and need different change management tools as use of checklist and process map and a change request form for proposing and managing change (Kerzner Kerzner, 2017). Also a proper communicating plan is important for communicating with several teams and project manager. DESIGN The pod-shaped glass viewing cabin topped by a 130 ft was reduced to 82 ft and glass is replaced with metal composite with silt-like viewing window. As the design change the architecture design and schedules also changed that leads to delay of opening the tower. TECHNICAL Tower elevator was too heavy to operate. Change on wing After opening for public in October 2001 it was closed again for this issue. OBJECTIVES The first objectives is to place a viewing cabin and provide a house for communicating with Science centre. It appeared that here was an urgent demand to put together the whole tower. The objective change, dramatically affect the project that leads to late opening and budget issues. Options and Associated risks The different options to satisfy the change request include determining the scope of the change along with the evaluation of scope of incorporating the change in the project (Hornstein, 2015). Serious technical risks innate in the tower project were identified and knowledgeable analysts were chosen to achieve the risk analysis in a timely manner. The biggest technical challenge of the project is the length of the tower as it has to be 10 time taller than its base width. The change of design of the tower and the technical team causes great risk of uncertainty (Hu et al., 2013). The Change request Form 1.) SUBMITTER - GENERAL INFORMATION CR# 01 Type of CR Enhancement Defect Submitter Name Project Manager Brief Description of Request The change is to be implemented in the developing and inception phase as the design and objectives of the project change dramatically. The elements of wing on the top of the building need to replace as heat can melt the glass. The elevator team needs to change cause the old team was on leave. The investment is also overrun 12 million dollar to 15 million dollar. Date Submitted 01/20/2001 Priority Low Medium High Mandatory Reason for Change The objectives change due to the certain requirement of the owner and stakeholders. The technical team has been changed because the old team members are on leave and elevator needs to repair immediately. Assumptions and Notes It is assumed that the requested change will have massive impact on the project schedule as extra 9 month will be required to implement the change. Comments This change cannot be implemented after project release as some important modification is needed to be done in the project code. Approval Signature [Approval Signature] Date Signed [mm/dd/yyyy] 2.) PROJECT MANAGER - INITIAL ANALYSIS Hour Impact 60hrs Duration Impact Approx. 9 month and after remaining 100 days numerous shut downs. Cost Impact Additional $3 million is required Comments The change required is although not huge, but it is mandatory since the owner and public satisfaction is an important aspect of this project. Recommendations Proper communication and understanding is necessary for implementing the change that is propose. Approval Signature [Approval Signature] Date Signed [mm/dd/yyyy] 3.) CHANGE CONTROL BOARD DECISION Decision Approved Approved with Conditions Rejected More Info Decision Date 03/05/11 Decision Explanation The change request plan has been approved by the board with the condition that no further delay will be accounted for the project. Approval Signature [Approval Signature] Date Signed 03/05/11 Scope Creep Scope creep usually refers to the uncontrollable, continuous and change in the scope of the project after the project has started executed (Thakurta, 2013). In this project scope creep occurred for the lake of communication and understanding between owner and first architect. To manage scope creep following steps must be followed- The project vision need to be cleared to meet the certain objectives through their review and comments. Understanding the owner requirement and be familiar with the current situations and make an well-organized list that can refer to throughout the project duration (Fleming Koppelman, 2016).Items should include, deadline, budget, delivery, feature, employee satisfaction and public satisfaction. Define deliverables and have them permitted by the project drivers. Deliverables should be general descriptions of functionality to be defined during the project. Conclusion Therefore, it can be concluded that in order to implement a change in a project, proper planning and communication is necessary. Change request can be implemented when a change in project processes benefits the successful implementation of the same. Proper identification of project requirements might help in managing the scope creep associated with a project. Reference Hornstein, H. A. (2015). I strode in front of four-hundred eighth graders with my arm slung over a Fender Stratocaster guitar and launched into the first few chords of Nirvana’s â€Å"Lithium.† My hair dangled so low over my face that I could not see the crowd in front of me as I shouted â€Å"Yeah, yeah† in a squeaky teenage voice. I had almost forgotten that less than a year before I had been a skinny geek whose excitement came from waiting for the next History Channel documentary. It was in the awkward, hormonal summer between seventh and eighth grade when I first heard Nirvana’s â€Å"Smells Like Teen Spirit.† â€Å"Smells Like Teen Spirit† shocked my senses out of a bland existence–until this point in my life my musical hunger had been fed mainly by my father’s Beatles CDs. I’m not sure if it was Kurt Cobain’s gravelly vocals, the driving, sloppy drum beats, or the punching wail of the electric guitar that consumed me, but as eighth grade began I had taken on the appearance of a brooding rock star. We will write a custom essay sample on Nirvana or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page My transition into a miniature version of Nirvana’s Kurt Cobain was almost complete as I entered eighth grade: my hair was greasy and hung down to my shoulders, I alternated wearing three Nirvana shirts daily, and I looked down on my friends’ inferior music taste. Only one aspect of my rock star persona was missing–I had no musical talent whatsoever. Lack of musical talent, however, did not keep me out of a rock band. Being in a rock band afforded me a kind of popularity. Despite the fact that no one had ever heard my band perform—our weekly practices quickly deteriorated into weekly video gaming sessions?my peers knew by my appearance that we had to be good. If my experience in a rock band taught me nothing else, it taught me that appearance is everything when impersonating a musician. My band took last place in the eighth grade talent show. I forced myself to make a slow and painful transition back to the real world and I entered high school as inconspicuously as the rest of my peers. Nirvana was the gateway that had opened my ears to everything from the Beatles to Bach. I even took music theory classes in high school. â€Å"Smells Like Teen Spirit† had released fourteen years of a pent up love for music within me. Perhaps the world simply had not been ready for an eighth grade Nirvana cover band.

Taxation in Malta Essays

Taxation in Malta Essays Taxation in Malta Essay Taxation in Malta Essay Taxation refers to the compulsory transfer of resources from the private individuals, institutions or groups to the public sector. Taxation can be classified under two types: direct and indirect taxation. Taxes that are levied directly upon wealth, income and capital gains are called direct taxes. Indirect taxes are those, which are additionally charged on prices or on the quantity of goods sold. Official documents issued by the Maltese authorities give four main objectives to taxation in Malta. Ensure an adequate and regular flow of revenue to government To be adjusted in light of Maltas relation with European Union To stimulate saving and capital formation as well as direct investment and personal efforts into productive channels. To ensure that financial burdens be borne by those most able to carry them. Since Malta gained independence, we have experienced various changes in taxation policies, both on the income and expenditure side. In fact the affects of taxation can be divided under two main categories. These are the Micro and Macro affects. According to microeconomic theory, tax changes affect a persons willingness to supply effort. This happens because taxation affects the relative price of work and leisure. The Macroeconomic theory states that changes in taxation have impacts on consumption and saving-investment decisions, in turn affecting total revenue collection. In order to see how tax burden is influenced today one has to consider the taxation history of the country. This is so since taxation is not a static event. The following are the main events in the taxation history of Malta. The government needed a type of taxation that managed to collect revenue for the government over time. For this reason in 1973 the PAYE, -(Pay-as-you-earn) income and the Provisional Tax (PT) were introduced. In 1977, there was a reduction in the company tax rate of 5%. With the election of the Nationalist party in 1987 the government modified certain regulation in the income tax structure. The 2%, 5% and 7% marginal tax rates for married couples and the 2% for the unmarried taxpayer were abolished. In 1991 the maximum marginal income tax rates were lowered from 65% to 35%. At this point it was also possible to opt for a separate income tax assessment. This was important since it encouraged married females to participate formally in the labour force. Another modification was introduced on the company tax rate where this rate was adjusted to be equal to the highest marginal personal income tax rate of 35%. In this way the government eliminated the possibility of avoiding tax liabilities through company profit. In the last budget the income tax rates for the married were revised. Value added tax (Vat) was introduced in 1995, substituting to a great extent, customs duties. In 1996 a final withholding tax of 15 % was introduced on part-time work and the income tax system was integrated with the Childrens allowance transfer scheme. In the same year there was a change in government administration. This brought an alteration of the tax system. In fact VAT was replaced by a Customs and Excise tax system. This system consisted of a 5% Excise tax on products a 5% Excise on services and a 15% Excise tax on imports. In 1998 a new Final Settlement system (FSS) substituted the traditional PAYE tax collection system. The FSS is a system where each employees pay accordingly, leaving no amount owing or owed to government at the end of the year. This system was introduced in order to relieve the Inland Revenue Department from the burden of processing future tax revenue arrears. If we look at the figures of revenue from income tax, we can observe that it remained stable throughout the years, reaching a peak in the late seventies and decreasing at a moderate pace after. National insurance contribution varied in the range of 30 37% of total revenue. This can be seen in Appendix 1. In the nineties there was increased importance of licenses, taxes and fines. On the other hand, revenue from Customs and Excise, which was significant in the eighties and in the seventies, began to lose its share in the early nineties. In fact as we see in Appendix 1 Customs and Excise collapsed to 8% in the mid-nineties, when VAT replaced it. In our analysis we dont have the figures for the later years where we suppose that the removal of Vat in 1997 would have increased Customs and Excise values for the years following until the Introduction of VAT that was brought in the last election when the Nationalist party was appointed. We can observe a graph showing the total revenue collected in taxation in the following country. The graph shows the continuous growth in total tax revenue collected by the government from 1971 to 1995. In order to analyse the tax burden in Malta we have to be able to analyse if the Maltese economy is overtaxed or not. If we therefore speak of overtaxed economy we are implying that there exists an optimal tax. This tax can be used as a yardstick for reasons of comparison. In 1945 an economist named Clarke attempted to determine this rate. Together with Keynes, Clarke suggested that when total taxation exceeded 25 % of Gross Domestic Product (GDP), damaging pressures would follow. So we can explain this 25 % as the limit that an economy is able to support. This concept of having a limit, after which damaging pressures may crop up, is also found in the Laffer curve. Arthur Laffer derived this in the 1970s. The relationship that he focused was the one between tax revenue and tax rates. This can be shown in the figure below. Laffer curve The principal rationale underlying the Laffer curve, is that the optimal tax rate is that rate which maximizes tax revenue for the state. This is point M in the diagram. Below the optimal tax rate, an increase in the tax rate increase tax revenue, whereas above the optimal tax rate, an increase in the tax rate reduces tax revenue. This happens since higher rates discourage productive efforts. Being derived intertemporally, the Laffer curve assumes that the optimal tax rate is consistent overtime, and that such optimal tax rate corresponds to a maximum level of tax revenue, which is also by implication consistent over time. The optimal tax rate corresponds to a particular level of GDP that is consistent over time. However we know that a developing economy tends to grow over time. In fact the economy is continuously subject to trade cycle fluctuations, which influence the overall performance of the economy. This shows that the Laffer curve could be considered being a simplistic approac h. During the period 1960-1980, research of the Maltese scenario has suggested that the tax rate index and tax revenue were positively related and upward moving. If we transfer this analysis to the Laffer curve analysis we can say that the, Maltese economy was still below the maximum rate M. Therefore according to theory a rise in tax rates could yield additional revenues. In an analysis on the data of the Organization for Cooperation and Development (OECD), Michael Beenstock extrapolated a linear function, correlating the average tax rate and the GNP per head. In this way we can compare Maltas past tax indices with those for Europe. In 1976, According to these calculations, Malta obtained a 26% rate of tax. The actual rate was 24 %. This means that tax rate was 2 points below the OECD average. From these results we can say that Maltas tax rate was considered to be fair from an international point of view. In order to judge critically the overall tax burden in Malta there exists mainly two methods. The first method refers to a time serious analysis. This method consists of acquiring data from the Maltese scenario and making an intertemporal analysis using statistical techniques known as regression analysis. The other method consists of an international comparison. In this case one can also use regression techniques in order to derive an internationally equivalent tax rate for the Maltese economy for the year 1994. A countrys tax burden is estimated by dividing the total amount of taxes paid by the GDP, that is, (sigma) sigma taxes /GDP). If we consider the international tax structure, studies have indicated the existence of a progressive element. This means that richer countries pay proportionally more tax than the less well-off (Delia 1982). So we can fit a regression line relating a countrys tax burden to its GDP per capita, using data for different countries. The countries chosen are OECD countries. The following data for the OECD countries is shown below.

What to expect from your book cover designer

What to expect from your book cover designer What to expect from your book cover designer You’ve written a brief and commissioned a designer. What’s next? In this guest post, bestselling book cover designer Simon Avery explains the process of working with a cover designer, from the first concepts up to the final payment.  Professional cover design is part of what makes a bestselling title. So it’s no wonder that successful indie authors are serious about the process. Once you’ve tracked down a cover designer you like, the first thing you’ll need is a good brief (which you can learn how to do with this guide). But after you've come to an agreement to work together, what comes next? Round One – The concept stageThe first and longest part of the process is the concept stage. In a nutshell, your book cover designer will take your brief and produce several potential ideas for a cover.Behind the scenesFor me, the concept stage takes between 1-2 weeks. In this time I create 10 or so designs, many of which will never see the light of day. The best 3-5 will be sent as concepts to the author to give a feel for how the final cover could look.In the concept stage I’m also doing a  number of things:Consulting image librariesA good designer will subscribe to a big selection of image libraries. This ranges from well-known libraries like iStock and Shutterstock to smaller specialist outlets. For example, I might consult a library that stocks edgy urban images. This also means my clients get pictures that are not in wide circulation. Image libraries charge for picture downloads. Some designers charge extra for this but I personally include it as part of my fee. The final concept stageArmed with the favourite concept, I then tidy up and polish. This is my favourite part of the process. I add any suggested changes. For example, an author might ask to change the eye colour of a character or make some element more or less prominent. For the most part, however, I’m just finalising the chosen concept ready to publish. The big finish! The cover is done and the author might use it to Tweet and gain social media prior to publication. When authors are happy with their cover they ‘sign it off’, meaning I forward them all the artwork and they pay me.Check out Simon Avery’s profile on Reedsy:  https://reedsy.com/simon-averyWant to learn more about Reedsy's book cover design professionals and how to work with them? Cross cultural management Essay Example | Topics and Well Written Essays - 1750 words

Cross cultural management - Essay Example The key messages that the author has tried to suggest in this article are that cross-cultural perception between supposedly similar groups in terms of similarity of national culture varies on the basis of the context in which the cooperation occurs between the groups (Heijes, 2011). The author asserts that power dynamics between different ethnic groups is one of the most fundamental drivers of the cross-cultural perception. Research along this line is a valuable aid that extends the understanding of the significant interrelationship between the culture and dynamics of power within organizations. The distinctive content of the article is that the author has achieved his objectives by compiling a comparative evaluation of the cross-cultural perception between two different ethnic groups. In the recent years, the number of cross-national studies has considerably increased, of which this research forms a part. The organizational research’s domain is getting increasingly internatio nal, thus raising concerns about the transportability of the models of social science across societies. The ethnic groups selected for the study were African Curacaoans and European Dutch. These groups were chosen in two organizations that operated in two different countries and the power dynamics of the selected organizations in their respective environments differed from each other. The author has used empirical evidence to demonstrate the way cross-cultural perception is influenced by differences of power. Â  ... The author has used empirical evidence to demonstrate the way cross-cultural perception is influenced by differences of power. Perception has been studied along two altering axes; the first of which was the external national context and the second was the internal organizational context. The author has studied the cross-cultural perceptions in Curacaoans and Dutch as well as in two organizations that were made part of the research; the police and the Internal Revenue Service (IRS). The author used these comparative case studies to offer a comprehensive account of the real-life cross-cultural perceptions between the selected ethnic groups so as to comprehend

PreCalc PARAMETRIC PROJECT Essay Example | Topics and Well Written Essays - 500 words

PreCalc PARAMETRIC PROJECT - Essay Example hand, each of the hyperbolas of parametric curves (5), (6), and (7) consists of two regions that reflect each other’s opposite courses of motion (clockwise and counter-clockwise). Apparently, a parametric motion is governed by equations where a third variable ‘t’, known as the parameter, is introduced. One discovers and comprehends that, in dealing with problems involving parametric motion, the concept of working with parametric equations is quite impressive in the sense that these equations are plotted as a single graph designed to illustrate movement along the ‘x’ and movement along the ‘y’ (Dawkins). To this extent, there emerges clearer understanding of the motion of a point particle as it occurs in two dimensions simultaneously. No wonder parametric motion has been applied widely in kinematics or in other similar fields that require the scheme of observing point particles in terms of their displacements, velocities, and elapsed time (t) of travel. As such, a typical kinematic problem is parametrically characterized by a projectile whose parabolic (or semi-elliptical) trajectory depicts the object’s velocity a nd displacement (on 2-D xy-plane) as a function of

City of Angels :: essays papers

City of Angels The film City of Angels depicts the existence of an angel watching over a doctor who is deeply shaken by the loss of one of her patients, thus making the reality of angels on earth a possibility for me. Not only does this film make me seriously consider the existence of celestial beings, but I now believe in the possibility that a guardian angel is looking after me. The belief in such beings can be comforting during times of need and in matters of life and death. City of Angels portrays the grace of Heaven meeting the beauty of Earth. Two souls, one mortal and one celestial, must struggle with their willingness and their need to sacrifice everything familiar for the sake of love. Seth is the guardian angel who watches over Dr. Maggie Rice. After learning that it is possible for an angel to become mortal if his love for a woman is deep enough, he realizes the strength of his love for Maggie and agrees to fall from heaven to be with her. Until I watched City of Angels, the thought of invisible beings guiding and protecting me was not a major interest of mine. At the age of eight my uncle, whom I was very close to, passed away, and his death was tragic. Being young and not understanding the concept of death, I had endless questions. â€Å"Where do people go when they die?† â€Å"Is there really a heaven or hell?† â€Å"Are their souls still on earth, just not visible to humans?† Providing some explanation to my uncertainties, the scene in the film involving a library book with a mysterious origin suggests one method in which angels could convey subliminal messages. Seth leaves the book with a section marked for Maggie to consider the existence of angels around her. This scene gives me the sense of spiritual beings roaming earth after death. So where is my late uncle now? In contrast with the belief that a person’s soul travels to Heaven or Hell after death, I feel that my uncle’s soul is still nearby. It is clear that my uncle is my guardian angel. Similarly to the scene in City of Angels where Seth leaves the book on the nightstand to send a message, I have felt as though my uncle was present in a time of concern. Of Mice and Men: How does the author show sympathy for Curley’s wife Essay

On the ranch there is a well known woman merely referred to as ‘Curley’s Wife’. As the characters develop we find that she is not in fact the unimportant, nameless character we first perceive her as, but rather she is a relatively complex one, with much more to her than we first gather, causing us to feel sympathy for her later in the novel. In this essay I will state how John Steinbeck influenced the reader to feel sympathy for Curley’s wife, especially after making the reader prejudice towards her. Steinbeck creates sympathy for Curley’s wife in numerous ways, one being her name. The fact that she never has a name outside of the reference to her husband clearly shows the reader that her identity is surrendered to a heartless husband. Evidence of this is when she admits that her husband ‘aint a nice man’ and that she never truly wanted to marry him. This leaves the reader with a impression of a unhappy, isolated woman to the extent that there is sympathy regardless of her outrageous behavior towards Crooks. Alternatively, the lack of a name for this woman could could suggest she is insignificant and not as important of a character as George, Lennie or any of the other men on the ranch. It could also be referring to how during the Great Depression, women were oppressed and treated less equally. Steinbeck may have portrayed Curley’s wife in this light to allow the reader to recognize the inferior role of women at that time. The lack of name relegates Cur ley’s wife to an insignificant status like a lot of women in a 1930s society. Steinbeck enables the reader to see Curley’s Wife through migrant worker Candy’s eyes on their first encounter her, as in his dialogue he refers to her as a ‘tart’. Through his words, we develop an initial perception of Curley’s Wife as as a bit of a ‘floozie’. Furthermore, Candy effectively accuses her of acting disloyal to her newly married husband Curley by saying, ‘she got the eye’ for other men. The word ‘tart’ suggests she presents herself in an ostentatious manner. Before even being introduced to the woman, the reader is convinced she’s to blame for anything that goes wrong in Solidad. Her physical appearance of ‘†¦full, rouged lips†¦Ã¢â‚¬â„¢, as  well as ‘fingernail painted red’ and elaborate hair, emphasize our preconceptions of her. I believe her attire is very significant to how we perceive her. She is said to be ‘heavily made up’ in primary colours (making her almost impossible to ignore or dismiss). This could be interpreted as her silent cry out for attention due to her being so isolated and lonely, after all there are no other woman on the ranch. Her appearance is portrayed as one of an actress or someone who has means of great luxury, this is why she is so incongruous on the ranch as she is not your typical housewife.. Her mien could also be construed as though she believes she is above any other woman who lives on a ranch, indicating she wants escape from her current lifestyle as her attire is suited for anything but her own. The description of her face being, ‘heavily made up’ could also propose the idea that she is insecure with her natural complexion. In other words, her face is a mask – it’s fake and not the real her. This makes a big connection of her ambitions of being an actress, a person that is constantly pretending to be someone they’re not. All of this contributes to the reader sympathising with her as she is so hopelessly insecure. On the other hand, Curley’s Wife’s appearance could be seen as naivety, and simply desire to be appreciated/noticed. Steinbeck may have portrayed Curley’s Wife with’ wide eyes’ to illustrate her as gullible or even that she is searching for something – which I believe was to be appreciated. If the text is analysed thoroughly, Steinbeck leaves subtle traces of evidence to help the reader understand her behaviour and fashionistic choices. ‘He says he was gonna put me in the movies’ is evidence of the ‘dream life’ Curley’s wife believed she was destined to have as she details twice ‘ I coulda been in movies†¦ I coulda sat in big hotels’ had her chance not have been stolen. This theme of lost opportunity or shattered dreams is often repeated throughout the story. The delusional mindset that leads to her cruel nature is the theme that makes the reader sympathetic to her. Red is a primary colour therefore people are attracted to it hence why Curley’s Wife wearing a lot of red may symbolise she desperately wants the  spotlight (attention) – much like many film stars. The description of ‘full rouged lips’ could be evidence of her attempt to be appreciated by the ranch workers; by drawing their attention to her lips it forces them to listen to what she has to say. Furthermore, another connotation of the colour is danger. A reason for Steinbeck portraying her as an associate of this colour may have been the foreshadowing of the blood that was to be shed. Finally, it is also a reminder of the girl in Weed who had a ‘red velvet’ dress that Lennie grabbed which caused him and George to go on the run, which we also know happens at the end of this novel. I believe Steinbeck structures Curley’s Wife’s character very intelligently as this subtle foreshadow indirectly makes a connection of the beginning and ending of the novel, also relating to her ambitions of being a movie star by the emphasis of a red ‘velvet’ dress. This indistinct description is often unnoticed causing the ‘reality vs: fantasy’ connection to be dismissed between Curley’s wife wearing a ‘cotton’ dress which immediately makes her no more than a housewife, however much she tries. Also on Curley’s Wife’s first appearance, the reader is made apparent of her alleged promiscuity as, ‘she put her hands behind her back and leaned against the door frame so that her body was thrown forward’, This suggestive and provocative body language justifies Candy’s statement of her and is hard evidence to the reader that she in fact a tart. However, we know this is not true. Curley’s wife shows similar traits to Crooks by standing in the door frame as he is isolated from it too. This causes the reader to feel sympathetic for her as she is secluded for being conceived as something she actually isn’t. Through no fault of her own, the men do not want to associate with her due them believing she is ‘jailbate’ ‘and a ‘rattrap’. This infers that the men are scared of her, something that frustrates her because she can’t comprehend why the men’s attitudes to her are so negative. The ‘rattrap’ could also be a forewarning of her escape to freedom which was only achievable by death. This is because once the rat trap’ (ie her) had been set off, it could no longer be used again, so effectively she committed suicide. I think that Curley’s wife and a rat are arguably similar as they are both hated by their relative society for being who / what they are, which is completely unfair. Also, rats are relatively small animals, this  could link to Curley’s wife as she feels and is perceived as dramatically insignificant on the Boss’ ranch. Curleys’ wife both talks and acts playfully and flirtatiously in front of the other workers. In my opinion she behaves in this manner because her sex is her only weapon to gain attention. Steinbeck could have been trying to make a point of her actions being relative to the era she lived in. I believe he deliberately portrayed her in this light with the intentions of making the reader feel sympathetic towards her in later chapters, but also to make the reader feel apologetic and penitent for labeling and being prejudice towards her. On one of her ‘looking for Curley’ routines she says, ‘They left all the weak ones here’ alluding to the three men, all ‘weak’ in their respective ways. However there is irony in this comment because she is seen as unworthy of a name thus why the reader can conclude that she’s unimportant. It is also ironic because she was left behind by all the men too, ‘Even Curley’. This causes the reader to feel sympathy for her as she is aware that she is just as marginalized as the ‘weak’ men. Evidence of this is when she rhetorically questions them. Here, the author is not only trying to show that Curley is a major obstacle in her having a proper conversation but Steinbeck is also emphasizing the fragmented relationship the couple have. The lonely and hostile side of the woman is revealed when she admits to feeling a shameless dissatisfaction with her life which inevitably causes the reader to feel remorse for her. Curley’s wife is again shown to be dislikeable by expressing bitterness when reffering to the men as ‘bindle stiffs- a nigger an’ a dum dum† The author presents her intense anger by stating â€Å"breathless with indignation† which explains her frustration. Finally, Steineck creates sympathy for Curley’s wife in the way that he portrayed her death as her true vulnerability is unmasked. ‘Ever’one knowed you’d mess things up.’ were the words from Candy when left in the barn with her body. The fact that none of the ranch workers, or even her husband, seemed to be particularly saddened of her death causes the reader to feel sympathy for her because it cements just how unappreciated she was. We  finally see her for the young victim she is as ‘the meanness and the plannings and the discontent and the ache were all gone from her face’. This repetition of discontent symbolizes that death was her escape because she is now away from being negatively labelled and misinterpreted. Steinbeck uses imagery to present her at peace after her death as she is described as, ‘†¦very pretty†¦sweet and young†¦Ã¢â‚¬â„¢ This causes the reader to feel sympathetic as the character we first perceived her as is gone. Also, the description of ‘young’ furthered my sympathy towards her as it suggests to me she had a short and unfulfilled life. My sympathy for her is also heightened in this chapter because her vulnerability is now clearly identifiable, for example she failed to understand the danger of Lennie – despite the evidence of his violent power in her husband’s mutilated hand and the dead pup he is grasping. The basic idea in Steinbeck’s description of Curley’s wife’s corpse is that in death her beauty can finally be appreciated. Furthermore, who can’t feel sympathy for somebody that is dead from no fault of their own? Personally, I feel most sympathetic towards Curley’s wife more than any other character in the book because she was in a constant battle to be accepted. What makes me most sympathetic though is that in finally letting her guard down to confide in Lennie, she was murdered. Even in her death she is nothing more than a scapegoat as she is referred to as ‘no good’ by Candy. She was never considered as a person, only as Curley’s showcase trophy. Curley’s wife, as Steinbeck depicts her, does not share Lennie’s innocence. Steinbeck rests a measure of blame for the killing on the victim herself which causes the reader to yet again pity her unfortunate life. Moreover, I feel sympathetic towards her because her dreams were futile and it was only at death that she could be rid of all the male dominance that corrupted and controlled her life. After all, it was a man who gave her the ‘false hopes entity’ that followed her to her life on the ranch, and no matter how hard she tried, she couldn’t leave the past behind. She ‘had the eye’ restlessly searching for true love and affection. Steinbeck gave Curley’s wife a circular structure that represents no matter how hard she tried to progress to her ambitions, her cycle always involved her finishing at her starting point, therefore no progress could ever made because her life was the  Ã¢â‚¬Ëœbeginning of the end’.
